This Privacy Policy (“Policy“) is a part of OneVN’s Terms and Conditions for User Services, indicating how OneVN collects, receives, stores, aggregates, processes, uses, discloses, and shares User information when accessing and using OneVN’s products and services provided through OneVN’s website/application/other available interactive channels. 

OneVN reserves the right to amend, supplement, or adjust the terms of this Policy at any time by publishing updates on OneVN’s website/application/other available interactive channels. Therefore, OneVN recommends that Users regularly monitor the Policy on OneVN’s website/application/other available interactive channels to stay updated on any changes to the Policy. 

By continuing to use OneVN’s products and services after the effective date of the changes to this Privacy Policy, the User signifies their acceptance of the content of the amended and updated Policy. 

I. DATA COLLECTED AND PROCESSED

OneVN collects and processes the following information and data from users: 

1.1. Information provided by the user

1. Full name (for individuals)/Full name (for organizations); 
2. Date of birth (for individuals); 
3. Gender; 
4. Phone number; 
5. Information and images of legal documents; 
6. Bank account and other payment information (excluding full card numbers, CVV codes, or other authentication codes with equivalent legal validity); 
7. A photo of the User’s face taken via a device; 
8. Information that the User provides from using the Products/Services, performing transactions, participating in contests, games, programs or events, using biometric features for personal identification or transaction authentication, making contact, filing complaints, conducting surveys, investigations,…. 
9. The information in items a, b, c, d, e, f, g for the legal representative and/or chief accountant (for organizations). 

1.2. Other information and data

1. Information and data about the User’s use of Products/Services; 
2. Transaction information and data performed on the OneVN application; 
3. Information and data about the application and device used (IP address, software, operating system, location, browser type, referring or visited website address from available interactive channels, mobile applications, number of visits, feedback, versions, advertising formats, and other relevant information, if any); 
4. Information and data that OneVN collects from third parties. 

When OneVN collects User Information from other sources, OneVN ensures that such data is transferred to OneVN appropriately and in strict compliance with the provisions of applicable law. 

1.3. The information and data of Children

In the course of providing Products/Services, OneVN may collect and process data of Users who are children under 16 (sixteen) years old. OneVN ensures this data collection must have the consent of the child and the child’s parent or guardian as required by regulations. OneVN’s processing of children’s personal data complies with the legal regulations of each period. 

1.4. Sensitive Personal Data

The data specified in items (f), (g), and (h) of Section 1.1 and the data specified in items (a), (b), and (c) of Section 1.2 are identified as sensitive personal data. OneVN will apply strict security measures to such data in compliance with the laws and regulations on personal data protection.

Personal data that does not mentioned above is identified as basic personal data.

II. PURPOSES OF DATA PROCESSING

OneVN processes data for the following purposes: 

2.1. To provide, personalize, maintain, and improve OneVN’s Products/Services for the User; 

2.2. To check and verify the accuracy, truthfulness, and completeness of the provided information; 

2.3. To implement measures to ensure network safety and security and to detect and prevent acts of fraud, scams, attacks, intrusions, unauthorized appropriation, and other illegal activities; 

2.4. To contact and notify the User when necessary; 

2.5. To provide support; process complaints and inquiries from the User; 

2.6. To assess and classify the User’s risk level; 

2.7. To authenticate the User’s information and access rights during the creation and use of Products/Services; 

2.8. To promote and introduce products, services, promotional programs, surveys, events, advertisements, and other content related to the products and services of OneVN and its partners. 

2.9. For research and development of products and services; 

2.10. To create service connections between the User and third parties (credit institutions, financial switching and electronic clearing service providers, goods and services providers, other third parties, etc.) 

2.11. To exercise the rights and obligations of OneVN in accordance with the law; 

2.12. Other purposes in compliance with legal regulations. 

III. PRINCIPLES OF PERSONAL DATA PROCESSING

OneVN commits to adhering to the following principles when processing data considered to be personal data:

3.1. OneVN shall process and protect personal data in accordance with the laws of Vietnam, as amended from time to time, and with the contracts, agreements, and other documents established with the User;

3.2. OneVN shall collect personal data for specific, explicit, and legitimate purposes, within the scope of the purposes stated in this Policy and in conformity with the laws of Vietnam;

3.3. OneVN shall consistently apply and update technical measures appropriate under the laws of Vietnam to ensure the security of personal data;

3.4. OneVN shall store personal data appropriately and only for the duration necessary as stipulated in Section VI of this Policy.

IV. RIGHTS OF THE USER

4.1. The User has the right to be informed about the data processing activities; 

4.2. The User, as the data subject, has the right to request the withdrawal of consent for personal data processing and to request the restriction of their personal data processing if there are doubts about the scope, purpose of processing, or accuracy of the personal data by sending a request to OneVN’s valid receiving channels. The User’s withdrawal of consent or request to restrict personal data processing does not affect the legality of the data processing that the User had consented to before the withdrawal; 

4.3. The User, as the data subject, has the right to view and request OneVN to correct their personal data. If this cannot be done, OneVN will notify the User with the specific reason(s); 

4.4. The User, as the data subject, has the right to request OneVN to delete or destroy their personal data, provided that the request complies with legal principles. The User agrees to accept all risks and damages that may arise from the deletion or destruction of personal data. If this cannot be done, OneVN will notify the User with the specific reason(s); 

4.5. In case damages arise for the User from OneVN’s violations of this Policy, the User has the right to claim compensation for actual damages in accordance with the law; 

4.6. The User has the right to file complaints, denunciations, or lawsuits in accordance with the law; 

4.7. Other rights as prescribed by law. 

V. OBLIGATIONS OF THE USER

5.1. The User shall comply with legal regulations and OneVN’s regulations; 

5.2. The User shall cooperate with OneVN in handling issues and incidents arising from the data provided by the User; 

5.3. The User shall provide information and data that is complete, truthful, and accurate. The User warrants and guarantees that they have the full right to provide this information and data; 

5.4. The User shall regularly stay updated on OneVN’s regulations and policies related to the processing of information and data announced via OneVN’s website/application/other available interactive channels; 

5.5. To be solely responsible in the event of information and data leakage or infringement due to the User’s fault; 

5.6. Other obligations as prescribed by law. 

VI. STORAGE

Information and data provided by the User will be stored by OneVN for the period necessary to fulfill the purposes mentioned in this Policy, ensuring the User’s continuous use of the Products/Services, unless a longer storage period is required or permitted by law. OneVN will take all reasonable actions to ensure that the User’s information and data are not kept longer than necessary, and OneVN will always comply with the requirements of Vietnamese law. 

VII. APPLICABLE LAW AND DISPUTE RESOLUTION

This Policy shall be governed by and construed in accordance with the laws of Vietnam. Any dispute, controversy, claim, or disagreement of any kind arising from or relating to this Policy shall be resolved by a court in Vietnam.

9.2. OneVN’s Products/Services may contain links to other services of OneVN’s partners. The User understands and agrees that each such third party will have its own privacy policy, and the User’s provision of information and data to these third parties is beyond the scope of OneVN’s management. Therefore, OneVN will not bear any responsibility or legal liability for the information and data provided to third parties in this case.
